Japanese Music Assignment Example | Topics and Well Written Essays - 250 words

Japanese Music - Assignment Example The Japanese one is a vertical flute, and we taut an upper lip, a lower lip stays relaxed, so the instrument can produce fuller, brighter, and more "detailed" sounds, which the Western flute cant make because the lower lip is not relaxed. The laxity of the lower lip is of importance when different variations of pitch and timbre are produced. As for Elizabeth Reian Bennett, deceleration, elasticity of beat and pitch within a certain range, as well as the use of silence, breath, and articulation when playing the instrument are other crucial things to note the difference between two flutes. I think, the uniqueness of shakuhachi sound makes it desirable to take part in so many music genres. For example, aficionados of classical music will find some sophisticated and somewhat tangle features in shakuhachi sound while the lovers of jazz appreciate its rhythm and timbre. In my opinion, such music prefer adults rather than teenagers because among youngsters other types of modern music, such as pop, rap or electronics, are popular. But I am the teenager who have found wabi, sabi, and yugen in a piece of music that touched my

Domain Name Disputes and Arbitration Essay Example for Free

Domain Name Disputes and Arbitration Essay The sudden explosion over the use of the internet in today’s world has placed domain names in direct conflict with trademarks. The use of a domain name would apply throughout the world, as the internet is accessible throughout the world. On the other hand, the trademark laws of a particular nation would vary with that of another, and hence, there is always a chance that trademark laws and domain name laws are in direct conflict with one another. Domain names would apply to the product and services of a service provider and hence ought to be given the same protection as trademarks . On the other hand, registries that register domain names give the importance of registering on a first-come-first served basis. Oppositions would say domain names contains alphabets and numerals, and hence, qualify to become a trademark. However, no rule is hard and fast. Domain name owners feel that the domain names are not protected under trademark laws as the internet is a global media having no offline limitation. On the other hand, the trademark owners feel that domain names are trademarks and hence are liable to file for dilution, unfair competition, etc . One of the main reasons as to why there is intense disputes with regards to domain names, is due cyber-squatting, in which somebody would register a particular domain name, and later try to sell it to the trademark owner. Domain name registries are accepting registration of domain names on a first-come first-served basis, and hence any person can register a popular trademark as a domain name and later plan to sell to the trademark owner. Often the prices quoted by the cyber-squatters are much more than what is paid of registration. Besides, cyber-squatters can misuse the trademark of the owner, and in turn wrongfully attract customers or tarnish the name of the original trademark owner . In the year 1995, the NSI framed a policy to settle disputes between domain name holders and trademark holders. The NSI is left out of the conflict and does not have the right to suspend the services of the domain name holder. Slowly, the importance of the trademark owners began to be felt. Trademarks owners can extent their services on to the internet, considering that it would be an ideal environment for business purposes. Customers on the other hand may also consider domain names being similar to trademarks for search purposes . One of the means of solving domain name disputes is by adopting the Uniform Dispute Resolution Policy implemented by the ICANN in 1999. This is mainly to solve the disputes that arise between domain name owners and trademark owners. The WIPO Arbitration and Mediation Centre would conduct the UDRP procedures. The process is much faster than the courts, and besides the decisions given is credible and impartial. The fees that are imposed are less than the routine courts . ICANN and UDRP The ICANN UDRP has been implemented for several TLD’s including . net, . com, . org, etc. However, it is not applicable to the country level TLD’s, such as . uk, . in, etc. The dispute resolution policy would occur between the domain name holder and the registering authority, such as country-coded domain registering organisation. The UDRP would set the terms and conditions that would arise in case of conflict arise between the domain name holder and any other party, except the registrar (ICANN). According to the ICANN, certain terms and conditions need to be followed when registering for a domain name. The registrant should ensure that all statements made are true, complete, and the domain name would not violate the rights of others. The domain name so registered would not be done for an illegal cause and would not be used to overcome any law. Any action done for the domain name would be lead to the owner being held responsible. The ICANN can transfer, modify or cancel a domain name registered if the domain name registrant requires so, if the court having a jurisdiction requires that the domain name be changed or cancelled or if a relevant administrative body requires that the domain name be changed or expelled. Depending on the situations, the ICANN would make a request to the domain name holder to perform such changes. The URDP procedure would be conducted before an administrative tribunal. Usually such tribunals would come into action whenever a third party has an issue with a particular domain name and files an application for objection before the ICANN.

Democracy in the novel Lord of the Flies :: essays papers

Democracy in the novel Lord of the Flies M.E. Sullivan said, â€Å"Democracy is only as successful as the people who make it work,† proves itself in the novel Lord of the Flies. I agree with this statement because, if there are to many people opposing one thing there will be war. The boys in this book struggled back and forth trying to establish a stable government. Democracy was forming in the group but, dictatorship was quickly sneaking up behind. Democracy was an essential thing for the boys to survive on the island. Ralph tried to form a democratic nation from the beginning using the conch as a symbol. Everyone listened when the conch was blown. The system was working but after a couple months people started to get different ideas of ruling. Jack, who was basically the leader of the underworld tried to replace democracy with a strong dictatorship. Since the idea of a new type of government, democracy was losing power quickly. Jack and his followers tried to bring down the democracy quickly because he or they wanted to be ruler. Jack did not want to be ruled by someone less superior than him. Jack and his group stopped obeying Ralph’s orders, and also they stopped going to the meetings when the conch was sounded. Jack started a rebellion against Ralph. Since the rebellion most of the kids joined Jack, and some stayed with Ralph. Two tribes were formed the democratic and the dictatorship tribes. Once the tribes formed, democracy was abolished. Jack didn’t have everyone under his rule so, he was still unhappy. To get the children of the island to follow him, he went to the extent of murder. Simon and Piggy were victims of two different governments colliding together. After the death of Simon and Piggy, Ralph was alone. The democratic group was finally gone. The dictators had taken over. In conclusion, democracy in this novel was over thrown by a dictatorship.

How does Byron present the lovers Essay

Byron feels very strongly about love, believing it to be a very good thing, especially when found in the young. Thus he presents the two lovers as sweet and beautiful. A third adjective, innocent could be added to the list and in Juan’s case certainly should be-however, throughout the passage we find hints that it does not apply to Julia. In stanza 106 Byron says that â€Å"her creed in her own innocence† was â€Å"immense. † So she believes forcefully that what she is doing is innocent and not wrong, and yet she knows it is: ‘†¦. she inly swore†¦Ã¢â‚¬ ¦. she never would disgrace this ring she wore. ‘ However, Byron does not damn her for thinking of ‘Don Alfonso’s fifty years,’ instead he justifies this behaviour in the hole of stanza 108. This is most probably because of Byron’s own feelings on the matter of love – he would not have backed away from extra-marital or adulterous love, believing infidelity to be a social normality. He believed that no shackles should be placed on love; it should be natural, and indeed this is how, to some extent, he does portray the love which blossoms here, though not as much as Juan’s later relationship with Haidei , ‘unconsciously she leaned upon [Juan]†¦ ‘ So, Byron shows us that Julia is aware of the wrongness of her impending deed, but he does not condemn her. Indeed it could be argued that Byron presents her infidelity as sweet and innocent in itself. The evidence for this can be found in the rhyming couplet at the end of stanza 105. ‘One hand on Juan’s was carelessly thrown, Quite by mistake – she thought it was her own. ‘ Clearly Julia knows the hand is Juan’s, but the lines are very tongue-in-cheek, and seem to be actually poking fun, very gently, at Julia’s pathetic attempts to make it seem as if she isn’t doing what she is. Byron is amused at her mock innocence and this in turn leads us to see her actions as less brazen and more innocent than they might seem. The fact remains though, that Julia is not innocent of adultery and this is conclusively shown in the lines, ‘Yet still she must have thought there was no harm, / Or else ’twere easy to withdraw her waist. ‘ So she is portrayed, seemingly paradoxically as a sweet and innocent, but knowing, adulterer. Don Juan, on the other hand, being only a young boy of sixteen is portrayed as completely nai ve and innocent. ‘His young lip thanked it with a grateful kiss And then abashed at its own joy, withdrew In deep despair, lest he had done amiss. ‘ The reader knows that he is completely nai ve, having previously read of his ‘breeding, which was strictly moral. ‘ So it comes as no surprise then that in this, his first romantic encounter, he should be ignorant of what to do and that Byron should portray him as he does. In conclusion then, the lovers are portrayed in some ways similarly but very differently in other respects. Byron reflects his attitude to love in portraying Juan and Julia as helpless in the face of their over-riding emotions – he describes love as ‘strengthening the weak and trampling the strong. ‘ This conclusion will suffice in the case of Juan but Julia is helpless in a different way. She is more worldly wise than Juan, having been married, and thus, almost certainly, sexual intercourse. She is portrayed as one caught in the middle of two pulling forces – her own ‘honour, virtue, truth and love for Don Alfonso,’ and her love for Juan. She knows that to display this love physically would be wrong, but she does it anyway – ‘And whispering, ‘I will ne’er consent’ – consented. ‘ Byron, however, does not condemn her for her actions, because of his belief in the power of love, and he portrays her still as a virtuous and sweet young woman, despite her ‘immoral conduct’. ‘A little still she strove and much repented,’ at the end of the passage shows she is still a woman of integrity, rather than one of loose morals. This is how Byron portrays the individual lovers. Together, they are depicted as a beautiful couple – ‘how beautiful she looked,’ – full of the initial exuberance of first love. Byron emphasizes the purity and goodness of their love over its illegitimacy in the eyes of the world and society, justifying it as much by describing its beauty as by showing why Julia’s marriage with Alfonso is not pure and good in stanza 108. In this respect Byron’s portrayal of the lovers in this passage is a continuation of the general theme of the hypocrisy of society in ‘Don Juan’. Ironically, Byron shows us, Julia’s legitimate marriage is un-natural and not really that good, whereas her illegal relationship with Juan is described with beautiful poetry, and is clearly more natural and proper than that of the former.

Nowadays, we all have problems when It comes to buying. Because we exceed In buying In the markets, we sometimes buy expensive dishwashing liquid. It nice that we use this sometimes, but sometimes we run out of money because of this. We also feel rough after we wash the dishes. The zamias dishwashing liquid can be a one- step solution for this problem. Because of the high oxalic acid content, the extract is considered as anti-bacterial, astringent, ant scorbutic, firebug, and stomach. B.What are the properties that make this product effective as an alternative dishwashing liquid? Why do we need to find the properties of zamias? And how are we going to find them? These are the questions that will challenge the researchers while they are conducting this study. Surely, conducting a research Is harder than It sounds and it will be harder to conduct a research that includes finding properties that will make a simple object into an alternative product. The researchers assume that this study will be successful and prove that zamias extract can be an alternative material for dishwashing liquid. The properties that we will find In kamala will make a strong reason for this study to be 100% successful. At this point, the researchers can already see that this study Is a guaranteed success. Zamias extract has already been used in many ways such as an alternative eye dropper, medicine for sore throat and also a prevention from getting diabetes. Now, the researchers will make a new use of zamias extract and that is as an alternative dishwashing liquid. Unlike any other products bought from the store that is expensive and may brought harmful effects for the user, this product will not only be cheap and affordable for the people, but also will bring beneficial effects for the user Instead of the harmful effects. The researcher's selection for this material Is a good choice because It has helped In many studies and may be a help for more In the future. 1.Zamias – is a small , sour and Juicy fruit found in zamias bearing trees in the garden and sometimes in the neighborhood and parks. 2. Astringent – is a material able or tending to shrink body tissues. 3. Ann-bacterial – prevents the build-up/accumulation of bacteria in a specific object/ location. 4. Eye Dropper – is a substance used to relieve itchiness, irritation and pain in the eyes. 5. Sore Throat – is the redness, sensitivity and painfulness in the throat. 6. Diabetes – is a disease in which too little insulin is produced and the body cannot SE sugar and starch in a normal way. F.This study is set only to give the properties of zamias extract, its purpose and other information's concerning this study. This study may have respondents but may not give exact number of respondents. Instead, the researchers will give the number of respondents by using percentage (Out of the respondents we surveyed, 75% agree that†¦ ) in the presentation. Lastly, the main focus of this study is to identify the properties of zamias that will help in this study, how many respondents will agree tit this study, and to give all the information necessary about this study. The researchers are going to conduct this research by finding the enough information they need to make this research more of a complete topic. That's why the researchers are going to study more about the properties of zamias that may be a great help into contributing to their study. Another reason why are the researchers studying this because it is not only a benefit for themselves but a benefit for the people if this study may turn out to be successful.

The effect of the American culture on my use of language

The effect of the American culture on my use of language Cultures are different in certain aspects. Language is one of the cultural aspects that differ across cultures. Although I am a Chinese, I am able to speak three languages, Mandarin, Cantonese and English. The notion that I am an international student, having come from a very different culture implies that I have been exposed to different cultures where the use of the English language varies. Advertising We will write a custom essay sample on The effect of the American culture on my use of language specifically for you for only $16.05 $11/page Learn More This follows from the fact that I have resided in the United States for more than one year after completing my high school studies in the United Kingdom. It is important to note that earlier on, I schooled in China where I began perfecting my knowledge in English. Based on this illustration, it is clear that I have encountered different cultural backgrounds that influence my use of language. The fact that t he UK and the US use different languages from the one I was used to presented a big challenge since I had to learn the language again. Although, both the UK and the US use the English language, it is evident that there are slight differences that become clear in the usage. When an individual joins a different place where the language used is not the same, it is sensible to learn the language used in the new location. It is thus necessary to learn the American English language in order to fit into the American culture. Learning the American English has taken control of the way I relate to my colleagues. This has become clear since, even amongst Chinese colleagues, the use of the American English is dominant. Further, the American culture has influenced the way we conduct ourselves. As an illustration, the Chinese people do not take direct commands, instead, they humbly submit. However, the American culture has forced those Chinese living in America to face off with people issuing co mmands. It is also worth to note that after coming to the US, one changes speech rules. By way of example, even though it may not be necessary to say a response, I find myself responding, an aspect that is ingrained in the US culture. As I indicated earlier, English differs across regions. As an example, the language version that is used in the UK is not the same as the one used in the US. As an English learner, I still experience problems despite the fact that I have learned the language for some time. I believe that some of the problems that I face are down to knowledge issues although others revolve around cultural aspects. The major problem lies on the idea that I began learning English in China. During the English lessons, the teachers did not take time to highlight any aspects of the American culture. As a result, I was not in a position to figure out how English is used within the American culture. Advertising Looking for essay on languages? Let's see if we can help you! Get your first paper with 15% OFF Learn More As an illustration, when one poses, â€Å"how are you?† a Chinese is tempted to think about himself whereas, the expression is used as a greeting. Additionally, in the Chinese culture, there are limited responses to greeting expressions. It is thus little surprising that after coming to the US I have learned more response expressions. It is evident that culture is influential in many respects. As the paper establishes, since coming to California, I have been heavily influenced by the American culture. Specifically, I have changed my use of language. I have also been able to enlarge my knowledge of English since the version of the language used in the US is slightly different from the ones used in China and the UK.

Guy De Maupassant Essay Example

Guy De Maupassant Essay Example Guy De Maupassant Essay Guy De Maupassant Essay Guy De Maupassant was a French author of the naturalistic school, who was generally considered the greatest French short story writer. During his last year of life, Maupassant suffered form mental illness. He was probably born at the Chateau de Miromensniel, Dieppe. His paternal ancestors were noble, and his maternal grandfather, Paul Le Poittevin, was Gustave Flaubets godfather. His parents separated when he was 11 years old. Maupassant grew up in his native Normandy. The gift of a photographic memory enabled him to gather a storehouse of information, which later helped him in his stories about Normandy people. Maupassant had suffered from his 20s from syphilis. The disease later caused increasing mental disorder. On January 2nd 1892, Maupassant tried to commit suicide by cutting his throat and was committed to the celebrated private asylum, of Dr Espirit Blanche at Passy in Paris, where the year after he died. I am going to write about the short story A Vendetta, in which I will explain some of the quotations to highlight the importance of horror and tension in the story. The story starts off with an important characters mother, in which she lived alone with her son in a tiny cottage on the ramparts of Bonifacio. : This is a starting scene of the story, and it tells you that she is a widow of Paolo Savrini. The writer goes into detail about the surroundings of the house, telling you that the town is built on a mountain spur. Then describes that in some places the ground is over-hanging, which gives you this ghastly feeling that the ground is going to collapse. The writer describes the sea as bristling reefs, which gives me the impression that the sea is moderately rough. Another quote is It is almost entirely enclosed by a gash in the cliff, which gives the audience a sense of closed confinement. The writer uses the word threading which gives me the impression that the sea is very choppy, and mysterious. The second paragraph starts off by describing how the houses are like nests of wild birds clinging to the rock, looking down on this dangerous channel, which tells you that the houses are right on the edge of the cliff, which sets the horror and fear to the story right into place. It makes me feel that the houses are going to fall into their watery grave at any minute. The story then continues by saying that the ships hardly venture into this part of the channel, which the writer is probably telling you that the ships might have been sunk here, and that no-one wants to venture here. The writer quotes that the wind harasses the sea remorselessly, and that gives me the idea that it is a cold, alarming sea. The writer describes patches of whitish foam around the black tips of the countless reefs, which tells me that by this description this patch of the sea is dangerously rough. The writer really describes the sea in much detail, and there is probably a reason for this. The story goes on and the writer really describes the sea a big part of the horror, tension and suspense in the story. The story changes as it stops describing the sea, and gets on with the rest of the story, by explaining the characters. The old woman in the story is a widow, and that her house is clinging to the edge of the cliff. This immediately gives me a sense of sadness for the old woman, as she has lost her loved one. I think that the old woman will have a big part in the story, as it is her house that the writer describes at the start of the story. The writer then introduces two other characters: her son, Antoine, and their dog Frisky. The dog is described as a raw-boned bitch, which tells me that the dog hardy eats anything and that you can see the dogs bones due to this. This also makes me think that the family is quite poor, as the dog is not well fed. he next part tells the audience that the dog is a sheep dog, used by Antoine as a gun-dog, which adds more tension and horror to the story, because a gun dog is used to hunt, and that means to kill an animal, so killing adds more tension and horror to the story. The story then changes from telling the audience about the characters, to actually carrying on with the story. The writer tells us that the old widows son, Antonie, was treacherously, knifed and murdered. The writer doesnt go into much detail about what happened, and doesnt go into much detail. The meaning of treacherously is deceitful and double-crossing, which means that Antoine might have double-crossed someone in order for him to be killed. The story carries on and says that a man called Nicolas Ravolati knifed him, and then escaped to Sardinia the same night. Sardinia is a boat away from Bonifacio, which meant that it was a quick and easy get away for him. I think that when it came to revenge, the widow wanted revenge instead of grieving, as she is described as motionless when the body came to her door. I think that she bottled her emotions up inside, as she refused to let anyone but her dog sty with her.

The Executive Branch of US Government

The Executive Branch of US Government The President of the United States is in charge of the executive branch of the United States federal government. The executive branch is empowered by the U.S. Constitution to oversee the implementation and enforcement of all laws passed by the legislative branch in the form of Congress. As one of the foundational elements of a strong central government as envisioned by America’s Founding Fathers, the executive branch dates to the Constitutional Convention in 1787. Hoping to protect the liberties of individual citizens by preventing the government from abusing its power, the Framers crafted the first three articles of the Constitution to establish three separate branches of government: the legislative, the executive and the judicial. The Role of the  President Article II, Section 1 of the Constitution states: â€Å"The executive Power shall be vested in a President of the United States of America.†Ã‚   As the head of the executive branch, the President of the United States functions as the head of state representing U.S. foreign policy and as the Commander-in-Chief of all branches of the U.S. armed forces. The president appoints the heads of the federal agencies, including the Secretaries of the Cabinet agencies, as well as the justices of the U.S. Supreme Court. As part of the system of checks and balances, the president’s nominees for these positions require the approval of the Senate. The president also appoints, without the approval of the Senate, more than 300 people to high-level positions within the federal government. The president is elected every four years and chooses his vice president as a running mate. The president is the commander-in-chief of the U.S. Armed Forces and is essentially the leader of the country. As such, he must deliver a State of the Union address to Congress once each year; may recommend legislation to Congress; may convene Congress; has the power to appoint ambassadors to other nations; can appoint Supreme Court justices and other federal judges; and is expected, with his Cabinet and its agencies, to carry out and enforce the laws of the United States. The president may serve no more than two four year terms. The Twenty-second Amendment prohibits any person from being elected president more than twice. The Role of the  Vice President The vice president, who also is a member of the Cabinet, serves as president in the event that the president is unable to do so for any reason or if the president steps down. The vice president also presides over the U.S. Senate and can cast a deciding vote in the event of a tie. Unlike the president, the vice president can serve an unlimited number of four-year terms, even under different presidents. The  Roles of the  Cabinet Agencies The members of the President’s Cabinet serve as advisors to the president. The cabinet members include the Vice President and the heads of 15 executive branch departments. With the exception of the vice president, cabinet members are nominated by the President and must be approved by the Senate. Mexico Versus venezuela research paper Essay Example | Topics and Well Written Essays - 500 words - 1

Mexico Versus venezuela research paper - Essay Example Another economical problem is that most of the country’s commercial bank assets are by the financial institutions of the U.S. This shows that Mexico is solely dependent on their neighbors in the top. If the economy of U.S were to collapse then, Mexico is to experience a big economical problem of their history. Another big problem facing the economy of Mexico is the big existence of drug cartels in the country. Mexico has a reputation of being the hub of drug lords to the likes of Pablo Escobar, who controlled most of the Mexico. These drugs end up ruining the youth of the country hence not being able to discharge their duties bringing a stalemate to the economy. Drug cartels bring violence to the country hence discouraging investment from foreigners in the country. In addition, these drugs bring about money laundering and this as well becoming perilous for the economy of Mexico (Krugman, 25). However, the best economic policy to this issue is by surely investing in education, infrastructure, telecommunications, energy and agriculture. It is to protect the poorest if the U.S economy starts to slow down. The government has to come with a better way of taxing informal commerce with the financial system in order for a business to pay for public investment. Mexico should try to collaborate with other countries and stop solely depending on U.S. Venezuela is the preferred country of choice. It is that Venezuela is very conscious when it comes to environmental conservation since its most territory is dedicated to the national parks and reserves. (Soto, 47). Big airlines like Air France, British, Lufthansa, Alitalia, and Iberia all serve Venezuela hence being a good economic fare. Economic freedom score of Venezuela is at 36.3 Venezuela is also a big player in the petroleum industry. This gives it a major economic boost. The country is also the most urbanized in whole of South America (Middlebrook 98). Despite

Characteristics of Film Noir Essay Example | Topics and Well Written Essays - 500 words

Characteristics of Film Noir - Essay Example Obscurity and profound black scenery reflected the sinister face of American dream (Westcombe). Film noir or black film referred to characteristic movies well thought-out to be apprehension pictures, murder mystery or misdemeanor melodramas (Hirsch 71). The late 1940s saw Hollywood put in place standard style to depict cops, lawbreakers and private detectives universally. Film noir also has a romantic recounting of love. Romantic narration is evident in films like â€Å"Postman Always Rings Twice† and â€Å"Double Indemnity† and creates the mood of an irretrievable past, a premeditated past and all-enveloping despondency (Hirsch 168). Dialogue is an essential element of film noir and it is usually brusque. Dialogue is brought about by characters who contemptuously or straightforwardly express themselves (Hirsch 74). Film noir characters often make wisecracks like in Mitchum in 1947’s â€Å"Out of the Past†. The wisecracker’s daring witticism and angry replies are risky and hilarious. For the audience, these aspects are impressive since the character, despite knowing they have messed up, cares less solely depending on their fast tongues and wits for rescue. Lighting in film noir scenes does not just involve light addition (Westcombe). Instead, lighting is used to form shadows which to the audience depict that danger prowls around the corner. Lighting in film noir should come from the sides as this varies the intensity across the person and creates depth to the subject through appending dimension (Hirsch 84). An exception of side lighting in film noir is during a criminal’s interrogation when the light can be bright directly on him or her. In addition, creation of sharp and discrete shadows is created using a single point of light. Sharp discrete shadows are used by audience to construct comprehensible mental images of the objects casting the shadows (85). Distinct approach to camera settings

Discussion posting Essay Example | Topics and Well Written Essays - 500 words

Discussion posting - Essay Example Using social networking is just one of the ways companies can exercises their HR practices as well as marketing and other activities of the company. It however should not restrict them using other advertising channels and mediums and rely solely on social networking if they are to get better and diverse results in future. Not every individual is on social media sites especially the older generation. If they are to get not only diverse customers but also diversify their target customers and expand their market, they will have to consider different factors such as the age of their customers or potential customers and what news medium each of the target group fancies or is complacent with and then incorporate all this information. Even when they use newspapers and magazines in addition to the social media sites, connectivity will still be achieved at the end of the day as all the requests and results are handled by one or two departments in the organization which can then merge all the information into one pool. My company is a technology firm and their target is mostly the young people even though once in a while the older generation above 40 years of age may be interested in the different forms of technology and they have to be incorporated as well. Majority of the marketing and recruitment is carried out through the social media sites particularly facebook and twitter as those are the two social media platforms with the highest followings in the nation. The company has advertised in facebook and when one joins their facebook group, they are provided in depth information including the career and internship opportunities, tender offers as well as sales on certain technological items the company manufactures. Product repositioning is another key area in marketing. Repositioning relate to the change of the image of product and also targets other buyers. Repositioning is also involves changing the market segment from one to another. Godiva chocolate manufactures change their product position to tween market segment. Currently they are targeting products in general consumers. Artist critique - Essay Example lasted for more than six centuries still exhumes realistic features of the early society with the artists portraying specific features of the painting thereby communicating as effective as he had fist anticipated. Renaissance refers to the period of rebirth; in culture and art, the period witnessed an increase in knowledge pioneered by some of the most realistic scientific inventions and religious realizations that have shaped the society to this date. Artists captured the social developments in their critical art works which helped portrays specific features of the society through the eyes of the artists. Italy has remained a strategic society in the development of both religion and scientific knowledge with most of Italian scholars and artists being among pioneers of the modern day knowledge. Piero della Francesca is therefore one of such artists who seek to portray features of the religion in the early Italian society. His works and type of painting influenced several others artists including Melozzo da Forlà ¬ and Fra Carnevale both of who were his fellow Italians. Piero della Francesca painted Saint Jerome and a Supplicant, in 1450 as his representation and criticism of the Christian faith that had spread to various parts of the continent. Religious art works were famous at the time as the Catholic Church sought to use such art to improve the reputation of the church. Most of such arts hung in churches and in homes of some of the leading figures in the church. The painting displays currently in New York museum of art. Still life is the subject matter in the painting, which adopts an abstract approach to art and the portrayal of the society in such works. The painter provides an abstract portrayal of the society developing a visible background, middle ground and fore ground in his image thereby communicating effectively through the painting. The activity in the painting centers on Saint Jerome, possibly a leader of the church at the time. The old frail man

Marketing - Fictisious Prodcut repositioning Essay

Marketing - Fictisious Prodcut repositioning - Essay Example They sell their product through retailers and other distributing outlets and they have a strategic position in chocolate gift baskets for special occasions. Product repositioning is another key area in marketing. Repositioning relate to the change of the image of product and also targets other buyers. Repositioning is also involves changing the market segment from one to another. Godiva chocolate manufactures change their product position to tween market segment. Currently they are targeting products in general consumers. Their product lines include coffee and cocoa biscuits and other branded chocolates, and their key marketing strategy focused on gift chocolate baskets meant for special occasions. Marketing report Essay Example | Topics and Well Written Essays - 1000 words

Marketing report - Essay Example In this kind of distributorship arrangement, the company cannot be an importer nor act as a commercial agent unless it is 100% Egyptian owned and managed. Second option is the Limited Liability Company wherein company has no limit on the percentage of ownership, provided that there is at least one or more Egyptian managers in the company, there are at least two shareholders or partners in the company and the capital should not be less than $9,000. Again, in this set up, the company cannot be an importer nor act as a commercial agent. Third option is a joint stock company that requires 49% of shares of stocks to be offered to Egyptians upon formation. Eventually, foreign stockholders may own 100% of the company provided majority of the board of directors is Egyptians and capitalization should not be lower than LE 250,000, with at least three Egyptian shareholders. Again, this type of distributorship may not import or act as commercial agent unless it is 100% Egyptian owned and managed . Another alternative is for foreign firms to register and sell direct to Egyptian consumers. They can do this by establishing their own subsidiary in Egypt or put up its own manufacturing assembly operation in Egypt. Foreign firms can use free zones areas or bonded warehouses to store goods and hire their own employees to sell their own goods. Foreign firms can also rely on Egyptian companies for wholesale and retail distribution who are specialized on wholesale and retail distribution. Besides, according to USCS (March 2011) Egyptian commercial agents are required for foreign firms to bid on most government tenders. Statistics from USCS provides the following data: As of 2007, there are 5,800 registered importers in Egypt, 9,600 exporters, 4,330 commercial agents representing 106,200 firms and 4,250 factories licensed to import components. Most of these firms are privately owned, but the government sector includes some 279 separate companies affiliated with 16 holding companies; n early 30 military factories that also make civilian products; and 1,500 companies owned by one of the 26 provincial authorities. Â   Trade Guide for Egypt considers U.S., Germany, UK, France and Italy as main suppliers. An important regulation that pertains to export regulations for foodstuffs is the quality inspection upon entrance to Egypt. Packaged items must be labeled in Arabic and should contain the name of the product, its trademark, its bran name, the product’s technical data and mode of operation, international marks and information that should be observed during transportation and handling, country of origin, production and expiry dates and manufacturer’s name. Exporters should also observe the international shipping and handling symbols, but should specify any special handling instructions in English and in Arabic. One channel of distribution that is getting to be popular in the internet is the B2B websites. B2B is the exchange of products and services or i nformation between business rather than business to consumers. Growth of B2B is estimated to be worth $7.29 trillion dollars in 2004 (Jones, Paula, 2000). Retailers and businesses in Egypt has its own B2B websites wherein business can view offers to buy, post offer to sell, view company directories, request shipping quotations and other details for trading business (Tradenetwork.com). B2B transactions have made trade faster and a reliable means of distribution. 2.

Doping in Sport Essay Example for Free

Doping in Sport Essay English Group discussion on Doping in sport. 22nd As we may all know doping can and has been a problem in some specific sports, cycling being the main scapegoat of course because of the Lance Armstrong scandal. However does that mean doping Is not involved with any other sports. Absolutely not, what many people believe is that cycling is a dirty sport because so many drugs and supplements are involved, however they do not realise some of the sports they love are heavily armed with many different cases. Cycling In fact Is now the cleanest sport n the industry because they dont let anything slip past. After seeing a documentary on Mark Cavendishs wins in the tour de France and the first Brit to become world champion In ages, he actually said that the doping chaperones wouldnt leave him alone and had to pester him until he took his drug test. What I am trying to get at is that people are being extremely close minded in terms of believing that their own favourite sport is clean. What do you think about banning athletes? Banning athletes is a very hot topic in the media whether or not it should happen, in y opinion the athletes that take and have taken these substances. For example Alberto Contador the Spanish cyclists who allegedly won the tour de France two years in a row, did this whilst taking a substance known as EPO. When he later got found out he was banned but not for life to the present day he still competes in the tour de France with no hassle, As well as still being able to compete he Is known as the two time tour winner still even though he doped. I dont think this is very fair in reality as why should he still be allowed that title when he cheated for it.

Sexual harassment at work

Sexual harassment at work Sexual Harassment In todays society, men in the organisation understand how to achieve higher positions than women. Indeed, culturally, character, style and ability between men and women are clearly different. There are several things that cause men to be more superior to women, regardless of physical affairs. For example, men are more rational and realistic, more competitive, more courageous, more initiative, and more aggressive. But that does not mean women should always be less than men. As women who live in the modern era of today, there should be a pathway to higher position and achievement in their careers. However women still need to be aware of various barriers that may prevent them from doing so. Nowadays, jobs such as director, manager or even chief executive officer (CEO) position are open to those women capable of filling these demanding positions. Now that women have slowly begun to make their way into organisation studies, the rate of issue such as sexual harassment is now becoming more popular, â€Å"when men and women involve in an emotional closeness may be a positive experience, but sexual harassment is not. Sexual harassment is illegal (Samson Daft, 2006). This assignment will further discuss how the issue of sexual harassment has an effect on womens participation in the workplace. Sexual harassment is any form of sexual connotation or behaviour that may be unilateral and unwanted by the person targeted. The result of sexual abuse may lead victims to feel ashamed, angry, humiliated, offended, and disgusted with the perpetrator. Sexual harassment can happen at any and all levels of an organisation. Women who are moving up the corporate hierarchy by entering male-dominated industries report a high frequency of harassment (Samson Daft, 2006). The Equal Employment Opportunity Commission (EEOC) combats sexual harassment by making illegal the acceptance of harassment as a condition of employment, using compliance or not to affect employment decisions with regard to the individual or creating a hostile working environment which may affect the individual performance. Itzin (1995) conducted a major research project with an aim to improving womens position within a local authority organisation. Itzin describes a five part methodology using a survey, interviews, group discussions, statistical data and participant observation to explore the culture and practices of the organisation and to collect data on the position and experience of women. According to Itzins survey results (1995, p.33), the majority of women in the organisation were ‘breadwinners, they work either to support themselves or their families. Most women said they work because they want ‘to pursue a career and ‘self fulfilment. Therefore by looking at this result, Itzin (1995, p.33) suggested ‘that there may be a little difference between the reasons why men and women work and the economic and emotional significance which they attach to their work.† Aside from sexual harassment there are various reasons why women are still far behind men. Through this table (1995, p.34) and diagram, Itzin shows the percentage of women had worked for the local authority for more than seven years and still yet not made any progression to their career . Reasons for women not applying for or not getting another job Reasons % At a disadvantage because of job sharing 5 Lack of encouragement 8 Obstruction from supervisors 8 Sexist Attitudes 8 Racist Attitudes 9 Lack of confidence 24 Lack of interview or job application skills 28 Lack of skills or qualifications necessary for the job 28 Promotion is all what it takes for women to achcieve a higher position. Male management restrict womens chances of prmotion by not providing suitable child care facilities or flexible school holiday arrangements. Itzin (1995, p.38) stated that â€Å"Managers do not encourage women to go for promotion, they said, or administrative staff to cross over into profession. They drew attention to the fact that ‘admin is dominated by women, but men are at the senior level. They thought women were better organizers and lateral thinkers than men, but management jobs were less attractive to women because they take you away from dealing with people and consequently provide less job satisfication.† According to Itzin, Women have to out performed men to get equal recognition and position and tend to have less power than men in the same position. Even though sex segregation is not exactly sexual harassment, but it is still discriminates against women in the organisation. Williams (1995) says that sex segregation almost always occurs in every organization and workplace, where males are in higher positions with higher salaries than women. There are various researches that show that sex segregation is a major obstacle for career women. This manifests as inequality in terms of salary, authority, opportunity in promotions and career advancement. Women are more often placed in a lower position with a smaller salary and without the opportunity to gain promotion (Hossain Kusakabe, 2005). Glass Ceiling discrimination may leads women to have feelings of low self-esteem, slowing down of interest in their jobs and decreased their motivation. The glass ceiling effect is a distinct limiter to a womans advancement into the higher level of corporate management and directorship. ‘â€Å"Ceiling† stresses the limitation of upward progress a woman is subjected to and â€Å"glass† refers to the fact that though the limitation is apparently not written in any rule book, it is nevertheless a defeated fact understood by both the sexes. (ayushveda, 2009). In theory, the effect of the glass ceiling can generally be viewed from two sides such as the demand side and supply side. On the demand side, from outside of the womans appearance, such as discrimination in the workplace, a culture of office man who is very dominant, work rules, and so forth. The glass ceiling in some cases can usually be overcome by using the supply side; it is something that is offered by the woman herself. These aspects include the choice of labour supply, quality of resources, skills possessed, and so forth. Every company toughest challenge that they need to face is to deal with sexual harassment issues. One of the best ways to prevent this situation is to make a sexual harassment policy. Companies must make a written rule that contains the companys commitment to prevent sexual harassment in the workplace. The content of the policy should include the notion of what constitutes sexual harassment, grievance procedures, and punishments that should be meted out to the perpetrators. It should also have counselling available to the victims and the assurance that the complaint made is confidential. Ensure all employees, supervisors, managers, directors, clients are aware of the written rules. Hence the human resource people need to take serious action to ensure that rules are obeyed. In conclusion, there are many courses of action that can be taken by companies and individuals in addressing issues such as sexual harassment and sex discrimination in the workplace. One important thing to note is that the right to pursue a career does not solely belong to men but women are also equally entitled. Although awareness in the workplace of womens right is growing, there is still much to be done to truly have equal opportunity without the threat of sexual harassment and discrimination for women.

Cubans Racist Attitudes Towards Blacks :: Race Racial Cuba African Cubans essays

Cubans' Racist Attitudes Towards Blacks Racism played different roles before, and throughout the the Spanish American War when Cuba finally became an independent state. Theories argue that there was very little racism in Cuba, that racism was brought by the Americans; Aline Helg begged to differ in her book, Our Rightful Share, and so will the following argument. When slavery was abolished in 1886 discrimination against blacks did not disappear. Helg argues: Cuban society remained divided along racial lines, when a child was born the first thing they had to state at registration was his or her skin color.? (Helg 25) Many places in Cuba simply refused to serve Afro-Cubans. On the other hand they now received wages for their hard work and certainly did enjoy some independence. Remarkably the Afro-Cubans maintained their pride. Even though they needed to accomplish more than whites in order to be rewarded, the Afro-Cubans did not sit still. Many leaders arose from the African descendants who shared their voices with the rest of Cuba. They created newspapers, La Igualdad, that joined the Liberation forces to ascend themselves, etc. The white Cuban society had a different view of these advancements; society feared that they would rebel like the Haitians, their solution was to repress more and more. Not physically, but as time went by there were less places for Afro-Cubans to inter-mix with the white society. Cubans launched the war for independence on February 24th of 1895. Each region rebelled independently: Matanzas, Camaguey, Oriente all rebelled by the end of 1895. This war of independence brought whites and blacks together. In general, the war against Spain brought men of completely different social backgrounds together. Blacks and whites, poor and rich joined forces to free Cuba. The Liberation army was an integrated body in the sense that there were no distinct black or white battalions. Some claimed that it was color-blind.?(Helg 59) The United States was interested in attaining Cuba for economic purposes and eventually they did. This created chaos between Cuban elites/whites and Americans. Americans brought back the Cubans that had been in exile in .America to rule the country. Their policies discriminated against the Afro-Cubans. In a way all Cubans were discriminated against by the Americans. ?After 1898, Cubans were affected not only by the socioeconomic and political impact of the US occupation but also by the racist contempt many North Americans felt for all Cubans, whether black or not. Moisture Content Experiment

Date: 09-02-2013 Experiment 1(a) Laboratory determination of water (moisture) content of a soil sample by oven drying method Reference: ASTM D2216-98 Need and scope of the experiment: In almost all soil tests natural moisture content of the soil is to be determined. The knowledge of the natural moisture content is essential in all studies of soil mechanics. To sight a few, natural moisture content is used in determining the bearing capacity and settlement. The natural moisture content will give an idea of the state of soil in the field.Apparatus: 1. Containers (Tin or Aluminum) with lids. 2. Balance, sensitive to 0. 01gm 3. Oven with accurate temperature control at 110 + 5oC (230 + 9oF) Discussion: 1. Moisture Content (w) It is defined as â€Å"the ratio of the mass of the ‘pore’ or ‘free’ water in a given mass of material to the mass of the solid material†. w=MwMs? 100 Mw = Mass of water in grams Ms = Mass of solid particles in grams (i. e. oven drie d weight of soil) 2. Representative quantity of Test SpecimenThe minimum mass of moist material selected to be representative of the total sample shall be in accordance with the following: Maximum particle size (100% passing)| Standard Sieve Size| Recommended minimum mass of moist test specimen for water content reported to  ±0. 1%| Recommended minimum mass of moist test specimen for water content reported to  ±1%| 2 mm or less| No. 10| 20 g| 20 g| 4. 75 mm| No. 4| 100 g| 20 g| 9. 5 mm| 3/8-in. | 500 g| 50 g| 19. 0 mm| ? -in. | 2. 5 kg| 250 g| 37. 5 mm| 1? -in. | 10 kg| 1 kg| 75. 0 mm| 3-in. | 50 kg| 5 kg|NOTE-1If it is suspected that gypsum is present in the soil, the soil sample should not be subjected to a temperature beyond 80oC. Otherwise gypsum would lose its water of crystallization, thereby affecting the results of moisture content. Oven drying at 80oC may, however, be continued for a longer time in order to ensure complete evaporation of free water present in the sample . NOTE-2To assist the oven drying of large test samples, it is advisable to use containers having large surface area and break up the material into smaller aggregations.NOTE-3Since some dry materials may absorb moisture from moist specimens; the dried specimens should be removed before placing new wet soil samples in the oven. Procedure: 1. Take sufficient number. of empty, clean containers and mark them (if they are not marked) with an identifying number or code. 2. Weigh the container and record the weight as M1 to the nearest 0. 01gm. 3. Take representative sample from different depths (0. 25, 0. 5, 0. 75m) from the field. 4. Quickly place the representative sample of the wet soil in the container. . Immediately weigh the container with the wet soil sample to the nearest 0. 01 gm. Record the weight as M2. In case it is not feasible to determine the weight immediately, cover the container with a lid. 6. Place the container with the soil sample in the drying oven at constant temper ature of 110+5oC for 24 hours (till constant weight is achieved). 7. After 24 hours remove the container from oven and weigh to the nearest 0. 01 gm. Record the weight as M3. Calculations: Mass of empty container = M1=4. 71(g)Mass of empty container + wet soil = M2= 43. 88(g) Mass of container + dry soil = M3=37. 41(g) Mass of water = Mw = M2 – M3 = 6. 47(g) Mass of soil solids = Ms = M3 – M1 = 33. 24(g) Moisture Content = w=MwMs? 100=M2-M3M3-M1? 100 Soil Moisture Content Determination: 1| Depth ( )| | 2| Soil Description| | 3| Container No. | 143| 4| Mass of empty container (M1), g| 4. 71| 5| Mass of Container + Wet Soil (M2), g| 43. 88| 6| Mass of Container + dry Soil (M3), g| 37. 41| 7| Moisture Content w = (M2 – M3)/(M3 – M1) %| 19. 46 %| Comments: ) Oven drying is a time taking process and not much accurate as speedy moisture meter. 2) It needs caring for long time in order to get the good results. 3) It needs attentions in case if some other materia l like Gypsum is present in the soil. In such cases temp. should have to be controlled otherwise the material may react and loose its water of crystallization which effects the results. 4) Above value of moisture content lies in Normal moisture content range. 5) Date: 09-02-2013 Experiment 1(b) To determine moisture content of a soil sample by speedy moisture meter.Apparatus: 1. Speedy moisture meter (also called calcium carbide pressure moisture tester) 2. Built-in scale for weighing 3. Two 1. 25 inches (3. 175 cm) steel balls 4. Cleaning brush and cloth 5. Scoop for measuring calcium carbide reagent 6. Calcium carbide reagent Introduction: The calcium carbide gas moisture tester provides a quick and simple means of determining moisture content of soil. It is particularly useful for field determinations of moisture content in conjunction with field compaction testing. The basic premise of the calcium carbide gas moisture tester is that the free moisture in the soil reacts with calci um carbide reagent to form a gas called acetylene gas. CaC2+H2O>CaO+C2H2 The acetylene gas pressure developed within the tester is displayed on the pressure dial gauge, which is calibrated to read directly moisture content (in %) by wet mass of soil. Since moisture content by definition is expressed as a percentage of dry mass of soil, the readings obtained by speedy moisture meter are corrected using the following expression: w=wsp1-wsp? 00 Where w = moisture content in %. wsp= moisture content as obtained by speedy moisture meter expressed as decimal fraction Procedure: 1. Weigh a 26 gram soil sample on the tarred scale and place it in the cap of the tester. 2. Place three scoops (approximately 24 gm) of calcium carbide and two 1. 25 in (3. 175cm) steel balls in the larger chamber of the moisture tester. 3. With the pressure vessel in an approximately horizontal position, insert cap in the pressure vessel and seal it by tightening the clamp.Take care that no carbide comes in conta ct with the soil until a complete seal is achieved. 4. Raise the moisture tester to a vertical position so that the soil in the cap will fall into the pressure vessel. 5. Shake the instrument vigorously so that all soil lumps are broken to permit the calcium carbide to react with all available free moisture. The instrument should be shaken with a rotating motion so that the steel balls will not damage the instrument or cause soil particles to become embedded in the orifice leading to pressure diaphragm. 6.When the needle stops moving, read the dial while holding the instrument in a horizontal position at eye level. 7. Record the dial reading. 8. With the cap of the instrument pointed away from the operator, slowly release the gas pressure. Empty the pressure vessel and examine the material for lumps. If the sample is not completely pulverized, the test should be repeated using a new sample. 9. The dial reading is the percent of moisture by wet mass and must be converted to dry mass. Note: If the moisture content of the sample exceeds the limit of the pressure gauge 20 percent moisture), use half of the soil mass and double the dial reading. Other methods of determining moisture content quickly: Other methods of measuring moisture content quickly include measurements by stove method and by micro wave oven methods. ASTM D4959-07 is used for measuring by stove method and ASTM D4643-08 is used to measure moisture my micro wave method. Results and Comments: Zero Error of Dial Gauge = 0. 8 Dial Gauge Reading = 17. 6 Corrected Dial Gauge Reading = 16. 8 Wsp = 0. 68 W (Moisture Content) = 20. 19 % * Speedy Moisture meter give better and faster result than the ordinary oven drying. * In this method the water present in soil reacts with calcium carbide and results in acetylene gas which in turn gives the value of moisture content. * Speedy moisture meter method is an efficient method as it doesn’t involve too much time for its performance. It is used when tests a re performed in the field. * Moisture content effects the soil resistivity, soil compaction and soil shear strength.

Detailed explanation of how other businesses support the retail sector P2 Essay

There are many different businesses that help in the retail sector to keep the business going and running efficiently and without these businesses it would be extremely hard if not impossible to get a business off the ground or even keep one running. Opening a sports shop in Manchester To begin with we need a place for all the money to go so that we can keep track of incoming and outgoing money so we need a business account with a bank. A bank is a business that provides a place for you to hold your money securely and also providing a way to track and manage your money and accounts making it easier for you to manage your taxes sales and expenditures and having an account you need someone to manage these for you so you would need an accountant there are businesses that can provide you with an accountant or accountants that will work for you they manage your accounts balancing your sales, expenditures and your taxes giving you more time to work on other areas of the business. A lot of business is now done on computers or if it’s a shop on tills so this requires a place for you to get your computers, tills or other hardware needed to run the store being a sports shop we will be using tills for the sales of products, computers for managing accounts and emailing, printers for making bank notes, receipts and bills and telephones for making calls to make sales and orders so we will need a phone company to provide us with a phone line and an account with them for phone usage, an internet provider to give us an internet connection so that we can send e-mails, check accounts online, make a website to advertise and even sell our goods on which will require a web designer who will make the website and manage it for us. We also need electronics stores that could sell us the computers, telephones and printers. Tills are a specialist item to buy so you will need to find a company that will provide and perform the necessary upkeep on them and we also need I.T specialists who can provide us with the software and management of the software for the tills and computers. We also need to find a supplier to provide us with the sportswear and sporting goods for us to sell a supplier is a company that usually make the goods themselves or buy it from the manufacturers and sell everything in bulk for a cheap price and then you sell the goods on for a profit, so they are two more businesses that can help us manufacturers and  suppliers without these businesses we would struggle to get the goods we need to sell. Then we need logistics companies to transport these goods to us and even from us to the customers, we might also need a place to store our goods so we will need warehousing and possibly security services to make it safe to store the goods so you might look into security companies/businesses that will manage the shops and warehouses. We also have accidents at work in stores and possible needs for legal action so we could do with lawyers/solicitors so finding a law firm that can help is also a good thing to be aware of. When you have problems with the buildings that you are using for your business activities you will need trades people to fix any issues you may be having i.e. Say your plumbing is leaking or toilet facilities or malfunctioning you will need to find a plumber to come and fix the problems you are having, if you need lighting or sockets or general electrical work doing you will need an electrician, if you are building a new building you will need architects, brick layers, window fitters, roofers, carpenters, electricians, plumbers, landscapers and possibly more to make your new building. If you want to expand your business and help it grow but you haven’t got the money for it straight away you might consider looking for investors who will give you the money upfront for your business venture for a percentage of the company profits. We also have accidents and tragedies that happen and could cause problems or losses within a company and for these times you can also get insurance from an insurance company who will help you and even pay for any issues that need to be fixed and solved. So to sum it all up there are many businesses that we need to make a business and to keep a business running and without these different businesses there would be no retail and no business.

12 Angry Men Analysis – 2

Nobody could forecast that a low budget movie with 12 different actors performing in one single room could affect in such a remarkable degree several sciences like law, business, psychology etc. The movie, based on the scenario that a 12 member jury group is about to decide through a certain procedure if a young boy is going to face the death penalty or not, can be linked with many theories referring to leadership or group/team work. Influenced by the Group Effectiveness Model of Schwarz (2002), the structure of the group along with the context and the process are vital for its effectiveness (Eirini Flouri & Yiannis Fitsakis 2007).In the first part of the film when the stage of forming, as it is claimed by the Tuckman’s Team Model, occurs, we notice the main characteristics of this group(David A. Buchanan & Andrej Huczynski, 2010). The group consists of 12 male middle aged white men probably coming from the middle class. Even from this first impression, admiring the effort of the film to achieve diversity, signs of prejudice appear. Specifically, the fact that all of them are men and moreover white men represents main biases of that period.Additionally, as it is mentioned to Sheldon’s Theory about the biases, the somatotype of each person declares in a certain way its character and this can be noticed by the selection of the characters and their match with the roles (Big guy is the tough one, smaller and thinner is the most innocuous, the handsome is the sensible and sensitive one etc. ) (David A. Buchanan & Andrej Huczynski, 2010). Despite the fact that the movie is trying to accuse such biases (which will be underlined later) certain ways of projection of that period could not be avoided. This is one of the reasons why in the remake of the film in 1997 black actors participated as well and later there even women were introduced in the team for certain theatrical versions. (Eirini Flouri & Yiannis Fitsakis 2007). The existence of a â€Å"one-offà ¢â‚¬ situation like this in the movie leaves space for less inhibition for conflicts. Moreover, specific factors like the size, the external-internal environment and the definition of the process play a crucial role in the structure of the group.Obviously, the size of this group is 12, but the question is: why so many? The reason is that by having a greater number of juries the system of justice achieves higher levels of democracy with less possibilities of getting unfair decisions combining the memory, the knowledge and the experience of each member and eliminates any prejudiced behaviors. On the other hand as Social Impact Theory mentions the more members there are, the less responsibility they feel (Latane and Nida, 1980).In the external environment we could enclose the time of the procedure, which is unlimited at first but with a deadline coming up afterwards, and the conditions of the place of action, which is characterized by the humidity and the high summer temperatures, th e broken air-conditioning, the unavailability of space. Such details could become the cause of stress, aggressiveness and as it was shown desire for fast result (just finish the procedure). In the internal environment issues like experience of previous similar situations, cultures, personalities, knowledge, mood, health, personal schedule and specialization could affect the result.Ending, a matter of significant importance is the definition of the procedure. In this case, we observe that after the release of the 2 alternatives there are 12 juries left. The juries have to decide if the boy is guilty or not guilty but there must be a full agreement (12 to 0) in each case; A democratic method which proves the importance of the situation. Alternatively, if they cannot reach an agreement they can decide a hung jury and then another trial will take place with different juries this time. The role of the foreman is usually for the most experienced person in this field or the first jury or fo r anyone who claims the desire and gets accepted by all. In the movie, juror1 supports this role setting the basic norms of the procedure. It is worth mentioning that nowadays, in the selection of the juries there is a specific procedure that is called â€Å"Voir Dire† procedure that clarifies the capability of the juries (Michael T. Nietzelt and Ronald C. Dillehayt 1982). Undoubtedly, the conviction of the biases of any kind is one of the main objects of this film. Primarily, in the first scheme, the judge seems really ninterested about the outcome and he seems to be sure about the result. The Halo Effect is â€Å"a judgment based on a single striking characteristic† and is being remarked in many cases during the film (Edward Thorndike, 1920). Moving to the main part of the film and the central procedure we can emphasize on the juror3 and juror10 who are the main representatives of such prejudiced behaviors. Both of them were trying to fill the gaps of their knowledge using selective attention in certain facts and their personal experience (â€Å"Principle of closure† by Max Wertheimer 1880-1943).Everyone has his stereotypes and if we imagine stereotypes as pictures in our head, jurors 3 and 10 have the image of a dangerous criminal for the defendant, raised to act in certain ways (Lippmann, 1922). More specifically, juror3 expresses, from his first lines in the film, his perception against the young boy (â€Å"I ‘d slap those kids before†¦Ã¢â‚¬ ). But as the movie goes on, he expresses again and again his personal beliefs connecting them with his personal disappointment from his own son (â€Å" it’s these kids they are these day†, â€Å"I used to call my father Sir†).Even more he presents his cultural stereotype against the elderly (â€Å"How could he be positive about anything? †) Eventually, juror3 stands alone with his perceptions, believing in the boy’s guiltiness and through a psycholo gical outburst admits that all his statements were based on biases. Similarly, juror10 uses his own belief to create his racial prejudice against the defendant (â€Å"I‘ve expected that†, â€Å"You know what we are dealing with†¦Ã¢â‚¬ ) as well as his past experiences (â€Å"I’ve lived with them†¦ they are born liars†).Adding to this, juror10 weights the value of the young boy less than the cost of a trial. Finally, his â€Å"explosion† made the apocalypse of his real personality and the group’s mechanism accused his behavior through a visual isolation and oral prohibition. The existence of biases in each group can create an unpleasant internal environment for each member and be the reason of conflicts. The productivity or the effectiveness of the group is in danger if such behaviors are being tolerated. Apart from the complexity which is created there is also a matter of fairness of the group’s function. As the movie flows, the influence of the group to each individual separately is obvious but a vice versa phenomenon is noticed as well. In this part, the different roles of the jurors and their influence on each other through the communication style of all-channel are being presented, as well as with some strategies followed by the leader-juror8. One thing that is common for most of the jurors is that they have common BATNA(Best Alternative to a Negotiated Agreement) and this is the hung jury. However, this is not the case for jury8 claims that his only purpose is the delivery of the justice (Fisher and Uri, 1981). Starting with juror1 we can notice signs of leadership in the early beginning but he ends up being more like a manager, organizing the procedure. Excluding the moment he reaches his breaking point and suggests if anyone would like to take his place, juror1is the one who sets up the norms, accepts propositions, guides the conversation and the voting procedure, avoids conflicts and respects pr ivileges keeping a democratic way of thinking.Being the foreman can be characterized as the â€Å"co-ordinator† (Beldin’s Team Role Theory 1996, 2007). Many of the jurors (2, 5, 6, 7, 11, and 12) seem to have low self-esteem not only because of their character but also because of the number of the team that forces them to get lost in the crowd or just finish the procedure and leave (â€Å"I just think he is guilty†, â€Å"Can I pass? †, etc) This is obvious from the first vote where only 5 of the 11 votes come directly and the rest are raised slowly just to avoid being pointed out. They are becoming followers(2, 5, 6 and 11) or entertainers (7) or just dreamers (12). Of course most of them are open to hear more and accept different opinions (2, 5, and 7). The rest just do not care so much about the result and these â€Å"free riders†, as Frohlich and Oppenheimer called them in 1970, are the proof that social loafing (or Ringelmann Effect) is a commo n phenomenon in big teams. The role of juror9 has a vital meaning for the outcome because he takes part in all the breaking points of the process.Firstly, he is the first supporter of juror8, secondly it is him who explains the old witness’s psychology (â€Å"Attention†) and lastly he is the fire starter for the fall of the woman’s testimony. The main opponents to the boy’s exoneration are jurors 3, 4 and 10. As was mentioned previously jurors 3 and 10 are mostly based on biases and stereotypes for children from slums. They are all concentrated on general facts and obvious details. The extensive use of loud voice is frequently the main argument of jurors 3 and 10, which could never strengthen their position.Alternatively, juror4 is using his logic and cleverness to support his facts and admits his fault proving his maturity, once he is convinced. Focusing on juror8 we can claim that he owns the position of the leader as his bargaining power is unique. Max Weber (1947) claimed that â€Å"bargaining power is the ability someone has to achieve his goals no matter of the resistance he faces†. Juror8 follows a series of strategies in order to be flexible and adapt to the needs of each occasion. In the beginning, as it is shown from Jo-Hari’s Window, everyone has a bigger unknown-black side, so juror8 wants to get information as an input.Eventually, he adopts the strategy of a listener in order to get knowledge from the others without revealing himself. Afterwards, in the first vote he stays neutral mentioning his points aiming to make some of the rest see the facts from a different angle avoiding any conflict. The brainstorming procedure just began. In order to wake up their consciousness he uses specific words like â€Å"maybe†, â€Å"supposing†, â€Å"possible† and â€Å"assume†. In the main part he listens carefully and argues with all the elements one by one. There is also an extensive use of rhetorical questions and irony just to make his point clear. The first action scheme is when he places the similar knife on the table. The leader breaks the law in order to prove his point. He becomes more active for the first time and gets the whole team upset. Eventually, he creates the first doubts. At this specific time he calls for a new vote. Apparently, the timing is not random. Probably he recognizes some voices like his and decides that it is time to set up a coalition strategy. He needs just one vote which will strengthen amazingly his arguments and he gets it.The fact that he uses his emotional intelligence to point out his views, while he realizes that some other jurors are playing, proves once again his leading abilities. The next step is to create personal relations with some of the jurors. So, he finds the weakest of the group who are about to change side and ask for their opinions. It is not by accident that these jurors were mainly followers until this time. Having established these connections, he uses logic and science as well as the experience and the knowledge of the group in order to persuade the others. As soon as he realizes that one of his main opponents (juror3) loses his self-control, juror8 becomes aggressive and pushes him to the limits using the technique of the irony to apocalypse the existence of his personal prejudice against the defendant. After completing his task, he shows his sympathetic character and supports the worried opponent. Based on Moscovici (1976) and his 5 Aspects juror8 is loyal to his beliefs(Consistency), responsible for his acts(Autonomy), flexible whenever it is appropriate(Rigidity), risky in the first secret vote(Investment) and willing to bring justice(Fairness). The impact of this movie in our modern times is initially proved by the fact that after so many years it is still being taught in courses not only in Law schools but also in Business and Psychology schools. Definitions like brainstorming, social lo afing, diversity, team-working, biases and preconceptions, attribution, personality, leader’s abilities, democratic voting and many others are part of any organization nowadays. This movie is the omen for the evolutionary development of a team structure, a team-worker’s behavior and a leader’s characteristics. Home is The Best Place To Die Essay Example | Topics and Well Written Essays - 1250 words

Home is The Best Place To Die - Essay Example Familiarity with a hospice inpatient setting is known to influence preferences in patients with advanced illness. The unique components of home hospice, inpatient hospice, and transitions between these settings may have a fundamental role in the future of quality end-of-life care (Lysaght & Ersek, 2013, p. 171). In a recent study, patients receiving specialist palliative care who had experienced an inpatient hospice stay were more likely to choose to die at the hospice, whereas a majority of those who had never been an inpatient at the hospice chose home (Arnold et al, 2013). Evidence also suggests that people with first-hand knowledge of hospices reported a preference to be cared for at home in the last months of life but shifted towards a preference for the hospice when asked where they would like to be cared for in their last days. Place of death should be regarded as an essential goal in end-of-life (Kinoshita et al., 2015). A study conducted by Barclay,  Kuchibhatla, Tulsky, & Johnson, (2013) established that most Americans would prefer to die at home. Similarly, there are barriers to dying at home for most patients with limited resources. It is necessary to provide health care professionals and caregivers to terminal ill patients. Also, psychological and emotional support from family members and relatives is useful in improving their conditions. Lastly, to reduce these barriers, there is a need for provision of equipment and medications to the patients. Statistical surveys by Neergaard, Jensen, Sondergaard, Sokolowski, Olesen, & Vedsted, (2011) reported that majority (80.7%) of terminally ill cancer patients preferred their homes as place for end of life. A further research revealed that 70.8% of the public indicated that they would prefer their homes as the place to spend the last days of their lives (Wilson, Cohen, Deliens, Hewitt, & Houttekier, 2013). Similarly, Higginson & Sen-Gupta’s (2000) reported on 18 studies on

Business Law Assignment Example | Topics and Well Written Essays - 1000 words - 4

Business Law - Assignment Example If so, what was the condition of the offer and who was to claim it? It has always been assumed that a notice like that goes all the way to the world and anybody can claim it so long as the terms are met. This is similar to the case of Carlill and Carbolic Smoke Ball Company (1893) 1 QB256. The claimant after meeting all the conditions put fore by Carbolic Smoke Ball Company was being denied the claim by the company. This attracted the intervention of the court which rewarded her claim. According to the law of contracts, an offer is simply an expression of willingness and ability to contract on given specific terms. It can be written oral or both. The offer can also be unilateral or bilateral, the latter mostly being in commercial businesses. In the case of Leila vs. Julie, the offer was unilateral since the former had in one of the dailies, printed a notice of the same targeting the whole public (Bouvier, 1856). The clear message was that whoever came across and returned the gold locket and the chain previously lost was to be rewarded $ 50. In a unilateral contract, once the offeror makes a promise in exchange of an act by another person, if this other person acts on the offerer’s promise then the latter is obligated to fulfill the promise (Austen-Baker, 2002). The ideal condition is that the information about the reward must have been in the knowledge of the offferee before presenting his actions. In this case, Julie was knowledgeable of the information about the reward for the return made by Leila. Whichever form of communication/ notification she chose, it was within the context. According to the notice, the offerer gave her address as well as her number meaning you could choose any to communicate and Julie happened to choose the physical contact. In my opinion, she qualified to be rewarded as the contract was binding. However, it should be noted that just like the case of (Household fire and carriage accident Insurance

Advanced Obstetrics for Paramedics - Assignment Example lead to acute anemia, delay or even failure of breastfeeding, hemorrhagic shock, pituitary infarction, coagulopathy, renal failure/acute tubular necrosis, coma, prolonged hospital stay, emergency surgery or angiographic intervention, need for hysterectomy etc. In a population-based research, it has been seen that risk of PPH is 5.8% in first pregnancy whether 4-5% in a second or third time pregnancy. However, risk is more than 15% in the subsequent pregnancy. Risk of PPH and average blood loss both are greater in caesarean section operations. Postpartum hemorrhage (PPH) can be defined as blood loss of 500mL or even more during and at the time of childbirth. In most severe case, blood loss of 1000mL or more amount of blood loss, which can cause hemodynamic compromise. PPH can be divided in to two categories that are primary PPH and secondary PPH. Primary PPH can occur within the first 24 hours after birth where as secondary PPH can occur in between 24 hours to 6 weeks of postpartum. However, in most of the cases PPH fall under the primary PPH category  (Kapungu, Koch, Miller & Geller, n.d.). Approximately 75% of the primary PPH cases are due to ‘Uterine Atony’. Secondary PPH is due to infection or retained products of conception. In developed countries, it becomes easy to manage in hospitals but in underdeveloped and developing country urgent PPH management is necessary. Risk of PPH can be reduced by almost 50% with administering oxytocic drugs. It has been seen that routine prophylaxis can help to reduce 70% of the need of oxytocics drug to heal excessive postpartum bleeding. Oxytocin is the most preferred uterotonic among the medical practitioners. It stimulates smooth muscle tissue of the upper part of the uterus (Lalonde & others, 2013). Oxytocin helps it to contract rhythmically. It facilitates constricting blood vessels and helps in decreasing blood flow in the uterus. It is an effective and safe choice for PPH treatment. Intravenous mode of infusion is

Commercial law - Essay Example On the other hand, a Cost, Insurance and Freight (CIF) contract refers to an agreement of selling shipped goods at a price inclusive of the total cost of the goods, freight to the port destination and the maritime insurance coverage. One of the major essential features of CIF contracts is that it requires the vendor to ship the agreed goods in the contract, procure a bill of lading (contract of carriage), arrange for the insurance of the goods, and make a commercial invoice before finally tendering the documents to the buyer1. For example, in the case Biddle Brothers v Clemens Horst Co.2, it was ruled that the buyer was obliged to make the payments before the shipment of goods. This paper offers advice to the parties involved in the case namely, Bernadette, David and Barkers Bank with particular focus to their obligations, limitations and potential remedies in the event that a breach of the contract occurs. Based on the circumstances facing Bernadette in the presented case, the major challenge that arises is whether under the English commercial laws, Bernadette would be able to recover the money she paid for the documents from Arthur, claim the insurance policy or take legal action against the carrier in tort compensation for the damaged goods since she had already made the contract payments. Bernadette is obliged by the law to pay Mr. Arthur (the seller) even if the rice was destroyed during shipment. This can particularly be seen in the case Manbre Saccharine Co Ltd v Corn Products Co Ltd[3]Â  in which the court ruled that that the seller may still claim payment even if the goods are lost or destroyed after shipment. In my opinion, the only available remedy subject the English commercial laws is to sue Claude’s vessel Jeanne d’Arc carrier for compensation of the loss incurred due to the damage of rice during the
